These Terms & Conditions (“Terms”) constitute a legally binding agreement between you (“User”, “you”) and HiVastu (“Company”, “we”, “us”) governing your use of our website www.hivastu.com and mobile application. By registering, accessing, or using our services, you confirm that you have read, understood, and agree to be bound by these Terms. If you do not agree, please discontinue use immediately.

1.Definitions

“Service” means the AI-powered Vastu analysis platform provided by HiVastu, including reports, features, and content.
“User” means any individual accessing the platform for personal use.
“Broker” means a registered real-estate broker using HiVastu's Broker Panel.
“Report” means the AI-generated Vastu analysis PDF delivered to the user.
“Content” means all text, images, reports, data, and other material on the platform.

2.Eligibility

You must be at least 18 years of age to use HiVastu's services.
You must be capable of entering into a legally binding contract under the Indian Contract Act, 1872.
By using the platform, you represent and warrant that you meet these requirements.

3.Description of Services

HiVastu provides AI-generated Vastu Shastra analysis reports based on property details and directional information provided by the user. Current plans include the Basic Report (₹99) and the Standard Report with Problem Solver & AR (₹299). Additional plans, broker bulk packs, and add-on services may be offered from time to time; the prices and inclusions shown at the time of purchase apply.

Important disclaimer: HiVastu reports are AI-generated informational documents based on classical Vastu Shastra principles. They are NOT a substitute for advice from a licensed, certified Vastu expert, architect, engineer, or any other professional. HiVastu does not guarantee any specific outcome — financial, health-related, or otherwise — resulting from following the suggestions in our reports.

4.User Accounts

You are responsible for maintaining the confidentiality of your account credentials.
You are responsible for all activities that occur under your account.
You must provide accurate, complete, and current information during registration.
One account per person. Creating multiple accounts to exploit offers is prohibited.
HiVastu reserves the right to suspend or terminate accounts that violate these Terms.

5.Broker Terms

Brokers must hold a valid RERA registration at registration and throughout their use of the platform.
Brokers are solely responsible for obtaining their clients' consent before entering client data.
Brokers may not misrepresent HiVastu reports as opinions of licensed architects or engineers.
Expired RERA registrations must be updated within 7 days of expiry; non-compliance may result in account suspension.
Broker report credits are non-transferable and non-refundable once purchased, except as per the Refund Policy.

6.Payments

All prices are in Indian Rupees (INR) and include applicable taxes unless stated otherwise.
GST at 18% is applicable on all digital services as per Indian tax law.
Payments are processed securely through Razorpay; HiVastu does not store your card or bank details.
Payment must be completed before report generation begins.
Prices are subject to change; existing purchased plans will not be affected.

7.Intellectual Property

All reports, AI-generated content, 2D floor plans, 3D renders, interior images, brand elements, and platform content are the intellectual property of HiVastu. Reports are licensed to you for personal or professional use (as per your plan) only. You may not resell, republish, or redistribute reports without express written permission from HiVastu.

8.Prohibited Uses

Using the platform for any unlawful purpose or in violation of Indian law
Creating fake accounts or providing false information
Reselling HiVastu reports or services without an authorised reseller agreement
Attempting to reverse-engineer, scrape, or copy the AI analysis engine
Uploading malicious content or attempting to breach platform security
Using the platform to make false or misleading claims to third parties
Impersonating HiVastu staff, consultants, or other users

9.Limitation of Liability

To the maximum extent permitted by applicable Indian law, HiVastu, its directors, officers, employees, and agents shall not be liable for: (a) any indirect, incidental, special, consequential or punitive damages; (b) any property purchase or investment decision made solely on the basis of a HiVastu report; (c) losses arising from AI inaccuracy or technical failures beyond our reasonable control. Our maximum aggregate liability to you shall not exceed the amount you paid for the specific service in question.

10.Consumer Rights (Consumer Protection Act 2019)

As an Indian consumer, you have rights under the Consumer Protection Act, 2019, including the right to seek redressal for deficiency in service. In case of a service deficiency, please first contact us at hivastuindia@gmail.com. If unresolved within 30 days, you may approach the relevant Consumer Disputes Redressal Commission.

11.Governing Law and Dispute Resolution

These Terms are governed by and construed in accordance with the laws of India. Any dispute arising from or relating to these Terms shall first be attempted to be resolved through mutual negotiation. If unresolved within 30 days, disputes shall be referred to arbitration under the Arbitration and Conciliation Act, 1996. The seat of arbitration shall be [City], India, and the courts of [City], India shall have exclusive jurisdiction.

12.Modifications

HiVastu reserves the right to modify these Terms at any time. Material changes will be notified via email and in-app notification at least 7 days before they take effect. Continued use after the effective date constitutes acceptance.
